Trial for driver in fatal L’Anse crash moved to February
L’ANSE — The trial date for a driver who was allegedly intoxicated at the time of a fatal crash in L’Anse last year has been adjourned until February.
Dawaun Johnson, 23, of Highland Park, Illinois, was working for the CR England company when his semitruck ran off the road and collided with the Holiday station in October 2022.
One person who was fueling his truck outside died in the crash, which also injured a worker at the store and severely damaged the building.
Johnson faces three charges in connection with the October 2022 crash: operating while intoxicated causing death, operating while intoxicated causing serious injury, and a misdemeanor charge of having an open alcohol container in a vehicle. If found guilty, he could be sentenced to up to 15 years in prison.
In August, Johnson sought to have the serious injury charged dismissed and have the case remanded to district court. He also motioned to exclude evidence collected after field sobriety tests were performed on Johnson that night, including blood-alcohol tests. The motions were denied.
The State Court of Appeals dismissed Johnson’s appeal of that ruling last week, saying it did not have jurisdiction because the orders were not final.
He had been scheduled to go to trial starting Nov. 1. On Monday, his case was moved to the February trial docket.
